TERMS OF USE

This Report has been created by PROPERTY MONITOR SOFTWARE & SERVICES L.L.C (“Property Monitor”, “us” or “we”) a limited liability company incorporated and registered in the Emirate of Dubai, United Arab Emirates with Dubai Economic Department Trade License No. 731886 with its registered address at Office 2205, Marina Plaza Office Tower, Dubai Marina, PO Box 118624, Dubai, United Arab Emirates, with telephone no. +971 (4) 453 9525, its nominees, successors, successors-in-title or assigns.

This Report is intended only for private, non-commercial, use by the individual for whom it was generated. By accessing this Report, you are agreeing to be bound by these terms of use and all applicable laws and regulations, and agree that you are responsible for compliance with all applicable laws and regulations. GOVERNING LAW AND DISPUTE RESOLUTION

The agreement to supply this Report and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by the laws of Dubai International Financial Centre.

Any dispute arising out of or in connection with the agreement to supply this Report, including any question regarding its existence, validity or termination, shall be finally settled by arbitration in accordance with the Arbitration Rules of the LCIA. The arbitral tribunal shall consist of three (3) arbitrators. The place or legal seat of the arbitration shall be the Dubai International Financial Centre, situated in Dubai in the United Arab Emirates. The language of the arbitration shall be English. The governing law of this arbitration agreement shall be the laws of the Dubai International Financial Centre

INTELLECTUAL PROPERTY RIGHTS

This Report and the information contained herein are protected by applicable copyright and trademark laws. You may not make a permanent copy of, reproduce or distribute, this Report or any of its contents in any form. You may only print or cache temporary copies of the content for your own personal non-commercial use.

In accessing this Report, you acknowledge that all data, calculations and outputs contained herein constitute the valuable property and confidential Intellectual Property Rights of Property Monitor and its licensors and you further acknowledge that you have no right to have access to any part of the data, outputs or Report in source code form or any method other than that in which the Report is supplied.

Intellectual Property Rights: means: (i) patents, trademarks, service marks, moral rights, rights in designs, trade names and domain names, rights in get-up, rights to goodwill or to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, copyrights and related rights, in each case whether registered or not, and any applications for registration of any of them; (ii) rights under licenses and consents in relation to any of them; and (iii) all forms of protection of a similar nature or having equivalent or similar effect to any of them which may subsist anywhere in the world.

INVALIDITY

If any part of these terms is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms will not be affected.

Property Monitor is committed to ensuring that your privacy is protected. We may use your personal information in our provision of services to you and our clients.  

For the purposes of the relevant data privacy legislation, Property Monitor is a controller for the personal information about you that it collects and uses. We will treat your personal information as confidential and your personal information will only be collected and used in accordance with applicable data protection legislation for the purposes of providing our services to you. SHARING OF PERSONAL INFORMATION
If you are using our services to access the Report at no cost then the service is being provided on behalf of one of our clients (with the service being paid for by our client), in any such case, personal information provided by you will be shared with the relevant client. By accepting these terms and conditions of use you are hereby giving consent for your personal information to be shared. If you would like to access the Report directly through us and do not wish to have your personal information shared, please contact us and we will make the service available under our direct to consumer model and costs.

PAYMENT GATEWAY

Property Monitor does not process payments directly nor do we collect, store, or have access to sensitive payment details. We have partnered with secure payment gateways provided through Network International (“NI”). When submitting payment(s) you will be redirected to services offered by NI, and any such redirect, embedded form, or link is not an endorsement of the payment gateway, nor are we liable for any failure of products or services offered by NI. NI may have a privacy policy different from than ours. All failures/errors/omissions of the payment gateway shall be solely on NI.

You agree to indemnify and hold Property Monitor, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Property Monitor by you or any third party due to or arising out of or in connection with your use of the payment gateway and any NI services.
